Do You Remove License Plates When Selling a Car in Texas?

Do you take the plates off when you sell a car in Texas?

Yes. Under Texas law, the seller removes the license plates from the vehicle at the time of sale. Texas plates belong to the owner, not the car, so when you sell or dispose of a vehicle you are expected to take your plates and your registration sticker with you. The buyer does not keep your plates. Instead, the new owner titles and registers the vehicle in their own name and gets their own plates through their county tax assessor collector office.

Texas Transportation Code Section 504.901 states that when a vehicle is sold, the seller shall remove each license plate issued for that vehicle. Removing the plates is not optional if you want to stay protected. It is the single easiest thing you can do to keep a sold car from coming back to haunt you.

What are my options for the plates I remove?

The Texas Department of Motor Vehicles gives you three clear paths for plates you take off a car you are selling:

  • Transfer them to another vehicle you own. You may move the plates to a different vehicle titled in your name, as long as that vehicle is the same class (for example, passenger car plates going onto another passenger car). Transferring your plates at the county tax office is simple and free. Note that the registration sticker does not move with the plates.
  • Keep them for a future vehicle. You can hold onto the plates and transfer them later to a vehicle you buy down the road, again if the vehicle class matches. The registration sticker is not transferred, so you will handle registration on the new vehicle separately.
  • Deface and dispose of them, or surrender them. If you are not going to transfer or keep the plates, you must destroy them so no one can reuse them. TxDMV says to deface the front of the plate with permanent black ink or a similar method to prevent fraudulent use. You can also surrender them in person at your local county tax assessor collector office.

How long do I have to get rid of plates I am not reusing?

Do not let old plates sit in a drawer indefinitely. Section 504.901 requires that a plate removed from a vehicle and not transferred to another vehicle be disposed of, in the manner the department prescribes, no later than the 10th day after you remove it. In plain terms, if you are not transferring or keeping the plates for another car, deface and discard them or surrender them within 10 days.

What is Form VTR-346 and why should I file it?

Removing your plates protects your car. Filing a Vehicle Transfer Notification protects your name. The Texas Motor Vehicle Transfer Notification, Form VTR-346, tells the state that you no longer own the vehicle as of the date of sale. You can file it online at the TxDMV Vehicle Transfer Notification portal or mail the paper form.

TxDMV recommends filing within 30 days of the date of sale. When you file the notification on time, you generally cannot be held responsible for parking tickets, toll violations, or other issues tied to the vehicle after you sold it. Until the buyer transfers the title, the vehicle can still show up in the state database under your name, so the VTR-346 is your paper trail that says the car left your hands.

What if I sell the car on a weekend?

If the sale happens on a Saturday or Sunday and you remove your plates and sticker, the buyer may need to move the vehicle before a county tax office is open. In that case the buyer can download a Vehicle Transit Permit from TxDMV. It legally allows driving the vehicle to the county tax office, or to another location if the office is closed, and it is valid for five calendar days. Only one transit permit may be issued per vehicle sale.

Why does removing your plates protect you?

Leaving your plates on a car you no longer own is a real risk. Those plates are still tied to your name in state records. If the buyer runs a red light camera, skips a toll, parks illegally, or worse, the violations can trace back to you until the title is transferred. By removing your plates and filing the VTR-346, you cut that connection at the source. You keep control of your registration, you prevent fraudulent reuse of your plates, and you have documentation showing exactly when the vehicle stopped being yours.
